Moore Digital Leads — Moore Solutions LLC

These Terms & Conditions (“Terms”) govern the services provided by Moore Digital Leads, a division of Moore Solutions LLC (“Company,” “We,” “Us”), to the client (“Client,” “You,” “Your”). By using our services, tracking numbers, or website, You agree to be bound by these Terms.


1. Service Overview

Moore Digital Leads provides inbound lead generation services through call tracking, Google Business Profile optimization, and related digital marketing processes. Leads are delivered through a dedicated tracking phone number that forwards calls directly to the Client.

We do not guarantee the number of leads, revenue, booked jobs, or any specific business outcome.


2. Lead Definition

A lead is defined as:

Any inbound call to the assigned tracking phone number with a total call duration of fifteen (15) seconds or longer, including ringing time, live conversations, and voicemails.

The following applies:

Calls lasting under 15 seconds are not billable.

Calls that reach voicemail or go unanswered are still billable if the total duration meets or exceeds 15 seconds.

Any qualified call counts as a lead regardless of the caller’s origin, including repeat customers, referrals, or individuals who found the Client by any method other than the Company’s marketing efforts.


3. Duplicate Calls

Calls from the same phone number within a 24-hour period count as one (1) lead, regardless of the number of attempts or total duration.

If multiple calls occur within that window, only the first qualifying call is billable.


4. Billing & Payment Terms

4.1 Pay-Per-Lead Billing

The Client agrees to pay the Company a fee for each qualified lead as defined above. Lead totals are calculated at the end of each billing period based on call tracking logs.

4.2 Payment Method

The Client authorizes the Company to charge the card on file or other stored payment method for all fees due.

4.3 Billing Cycle

Invoices are generated monthly, unless otherwise specified in writing.

4.4 Payment Due Date

Payment is due immediately upon invoicing. The Company reserves the right to automatically charge the payment method on file.

4.5 Non-Payment and Service Suspension

If payment fails or remains unpaid:

Services may be paused or terminated,

The tracking number may be deactivated or reassigned, and

All outstanding balances remain due.

Leads delivered before suspension are still fully billable and must be paid in full.


5. Refund Policy

No refunds are issued for valid leads delivered according to the definition in Section 2.

Refunds are not provided for:

Leads the Client fails to answer,

Missed calls,

Voicemails,

Callers the Client cannot reach,

Leads that do not convert into paying customers,

Repeat customers or referrals,

Seasonal fluctuations or changes in call volume.

All qualified lead charges are final.


6. Client Responsibilities

The Client agrees to:

Answer incoming calls promptly,

Maintain accurate business information,

Provide updated contact details,

Cooperate with call tracking setup,

Operate in compliance with all local laws,

Notify the Company of any issues with call forwarding,

Review invoices and lead logs in a timely manner.

The Company is not responsible for the Client’s ability to close or convert leads.


7. Call Tracking & Recording

The Client acknowledges and agrees that:

Calls may be logged, time-stamped, and recorded,

Call metadata may be used for billing, quality assurance, and service improvement,

The Client is solely responsible for complying with applicable state and federal laws regarding call recording and customer consent.


8. Ownership of Tracking Numbers

All tracking phone numbers provided by the Company remain the exclusive property of Moore Digital Leads / Moore Solutions LLC.

Tracking numbers:

May be changed at any time,

May be disabled upon cancellation or non-payment,

Cannot be transferred, ported, or claimed by the Client unless explicitly agreed in writing.


9. No Guarantee of Results

The Company does not guarantee:

A specific number of leads,

Job bookings or revenue outcomes,

Improvements in ranking or marketing performance,

Seasonally consistent call volume.

Lead volume varies based on market conditions, competition, and other factors beyond the Company’s control.


10. Term, Cancellation & Termination

10.1 Term

These Terms remain in effect as long as the Client uses the tracking number or receives leads.

10.2 Cancellation

Client may cancel services at any time by written notice. All qualified leads delivered before cancellation remain billable.

10.3 Termination for Cause

The Company may terminate service immediately for:

Non-payment,

Abusive behavior,

Fraudulent activity,

Misuse of the tracking number,

Violations of these Terms.

Upon termination, the tracking number may be permanently disabled or reassigned.


11. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for:

Missed calls or unreturned calls,

Business losses, lost revenue, or lost profits,

Service interruptions or technical issues,

Any indirect, incidental, or consequential damages.

The Client assumes full responsibility for converting leads into customers.


12. Indemnification

The Client agrees to indemnify and hold harmless Moore Digital Leads / Moore Solutions LLC from any claims, damages, or legal actions arising from:

The Client’s business operations,

Interactions with callers,

Violations of call recording or consent laws,

Use of the tracking number.


13. Data & Privacy

The Company collects and stores call data solely for service delivery and billing. Data is not sold to third parties. The Client is responsible for handling and storing consumer information in accordance with all applicable laws.


14. Access to Client Digital Assets (Google Business Profile, Facebook, etc.)

If agreed upon by both parties, the Client may grant the Company administrative access to digital assets necessary for lead generation and marketing optimization. These may include, but are not limited to:

Google Business Profile (GBP),

Facebook Business Page,

Meta Business Suite / Facebook Ads Manager,

Instagram Professional Account,

The Client’s website or hosting dashboard (if applicable).

14.1 Scope of Access

With granted access, the Company may:

Update business information,

Upload photos or posts,

Adjust categories, service areas, or descriptions,

Manage inbound messages where applicable,

Optimize profiles for improved visibility,

Connect tracking tools or analytics,

Implement tracking numbers or call-forwarding systems.

14.2 Client Responsibilities

The Client agrees to:

Provide accurate and current business information,

Maintain ownership of all accounts,

Ensure the Company has appropriate permissions to perform services,

Notify the Company of any changes to login credentials or access requirements.

14.3 Limitations of Liability

The Company is not responsible for:

Platform suspensions caused by prior activity,

Inaccuracies in Client-provided information,

Changes to platform policies by Google, Meta, or others,

Unauthorized access due to Client sharing credentials with third parties.

14.4 Access Removal Upon Cancellation

Upon cancellation or termination:

The Company will remove its access from all Client accounts,

The Client must revoke any remaining permissions,

Any tracking systems implemented remain the property of the Company unless otherwise agreed in writing.


15. Modifications to Terms

The Company may update or modify these Terms at any time. Continued use of the service constitutes acceptance of the updated Terms.
